1. Posible Mala Conducta del Departamento de Justicia.
Un juez federal ha criticado al Departamento de Justicia por su manejo del caso contra James Comey, citando posibles errores de investigación y mala conducta del gobierno.
- Judge says justice dept. May have committed misconduct in comey case the magistrate judge raised the question of whether government misconduct in the case might require dismissing the charges against the former f.b.i. Director, james b. Comey, altogether.
- Federal judge blasts potential government misconduct in comey case a federal judge excoriated the justice departmentciting a disturbing pattern of profound investigative missteps and government misconduct that could threaten the viability of the case.
2. Dudas sobre la Presentación de Pruebas al Gran Jurado.
Existen dudas sobre si el gran jurado recibió la información correcta y si se les indujo a error sobre la culpabilidad de Comey.
- The government tried to charge mr. Comey, but they broke important rules, didnt follow the law, and didnt even give the grand jury the real charge in time, so his lawyers say the whole case should be thrown out.
- No telling what this government presented to the grand jury. If ther is misconduct identified i hope law licenses are lost. There must be consequences.
- Halligan told the gj they could be assured the government had more evidence perhaps better evidence that would be presented at trial. Someone i know is on a gj now and said ive been doing this literally only 2 weeks and know thats not ok.
3. Posible Violación de los Derechos de Comey.
Se alega que el gobierno violó los derechos de Comey al presentar información privilegiada y al sugerir que él debía probar su inocencia.
- Among other things, the government relied on information it obtained in violation of the fourth amendment and the attorney-client privilege and it made serious misstatements of law to the grand jury.
- Halligan told grand jurors the government was not required to prove james comey was guilty it was up to him to prove his innocence.
4. Consecuencias Potenciales.
La mala conducta del gobierno podría resultar en la desestimación del caso y posibles sanciones para los abogados involucrados.
- The court should sanction the government attorneys for this blatant lie which is easily provable to be a blatant lie.
- If this is truly what the government admitted, the case isnt merely weakenedits structurally unsound. An indictment that never goes before the grand jury isnt an indictment at all, and any court is going to treat it accordingly.
- The comey case must be dismissed. The government has the duty and responsibility to get it right. They didnt. Grand jurors never agreed to the indictment presented to the court. It must be stricken.
